Buying a villa or plot in Kasauli: questions buyers ask

Can a non-Himachali buy property in Kasauli?

Under Section 118 of the Himachal Pradesh Tenancy and Land Reforms Act, non-Himachalis generally need state permission to buy land, granted case by case. Buying a finished unit from a properly approved project may be simpler, but the rules have been under review, so check with a local lawyer.

Are stamp duty rates different for outsiders in Himachal?

Himachal has historically charged higher stamp duty to non-Himachali buyers than to residents. Confirm the current rate with the sub-registrar or your lawyer before budgeting.

How far is Kasauli from Delhi and Chandigarh?

Kasauli is about 1.5 hours from Chandigarh and typically 5 to 6 hours from Delhi by road, via the Chandigarh–Shimla highway (NH-5).

What practical issues apply to Kasauli homes?

Kasauli has a cantonment area with its own controls, steep access, monsoon landslide risk and seasonal water constraints. Building rules in Himachal hill towns can be strict. Ask about the approvals, water source and road access in the monsoon.

Can I buy agricultural land or a farmhouse plot if I am not a farmer?

It depends on the state. Maharashtra and Gujarat allow only registered farmers to buy agricultural land, Karnataka relaxed this in 2020, and Himachal Pradesh (Section 118) and Uttarakhand restrict buyers from outside the state. Non-farmers usually buy NA (non-agricultural) converted plots in approved layouts. Check the land record and conversion order with a lawyer before paying.

Can an NRI or OCI buy a villa or plot in India?

Generally yes for residential and commercial property, including residential plots. Under FEMA, NRIs and OCIs cannot buy agricultural land, plantation property or farmhouses without special RBI approval, though they can inherit them. Payment must come through normal banking channels (NRE, NRO or FCNR accounts or inward remittance). Rules on repatriating sale proceeds have limits, so check the current RBI directions with a lawyer or your bank.

Does a plotted project have to be RERA registered?

Under the RERA Act, plotted developments are generally covered. A project usually has to register unless the land is 500 sq m or less, or it has eight units or fewer, and some states set their own thresholds. Check the number on the state RERA website before paying a booking amount. Managed-farmland sales often sit outside RERA, so ask exactly what you are buying.

What is the difference between a plot loan and a home loan?

A plot loan funds the land only. It usually carries a somewhat higher rate and a lower loan-to-value than a home loan, and lenders often expect construction to start within a few years. Tax benefits generally apply only to the construction part once you build. Banks rarely lend on agricultural land for non-farm use, and NRI eligibility varies by lender.

What one-time costs should I budget for besides the price?

Stamp duty and registration, which vary by state and are charged on the higher of the deal value or the circle rate. Add GST if you buy an under-construction villa from a developer, and TDS under Section 194-IA (1% when the value is ₹50 lakh or more and the seller is resident; higher rates apply if the seller is an NRI). Budget too for legal due diligence, society or club deposits, utility connections and, for plots, construction. Confirm the current rates with the sub-registrar or your lawyer.

Will a second home earn good rental income?

It depends heavily on location, design, management and how often you use it yourself. Published estimates for villas in popular markets range from about 3% to 8% gross a year, and data from short-term rental trackers often shows lower occupancy than brokers quote. Maintenance, staff, utilities, management fees and tax reduce the net figure. Treat projections as estimates, not promises.

General information, not legal or financial advice. Rules change; check with a lawyer and your state RERA before you pay.
